1. Scope and Agreement

These Terms and Conditions (“Terms”) govern the use of the AutoAlt.ai platform, services, extensions, and all related content provided by webAufstieg GmbH, Anton-Huber-Straße 20, 73430 Aalen, Germany. By accessing or using any part of the Service, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not access or use AutoAlt.ai.

2. Electronic Communications

By using AutoAlt.ai or sending us emails, you agree to receive communications electronically. These communications satisfy legal requirements for written communication.

3. User Account

You are responsible for maintaining the confidentiality of your login data and for all activities under your account. Transfers outside your organization require written permission. Users under 18 may only use AutoAlt.ai under supervision. We reserve the right to suspend or terminate accounts at any time.

4. Subscriptions, Billing, and Refunds

Subscriptions renew automatically unless canceled before the next billing cycle. Payments are processed via Stripe. Prices are shown in EUR (incl. VAT as applicable). Refunds are not provided for partial usage periods.

Cancellation

You can cancel your subscription at any time via your account settings. Your access will remain until the end of the paid billing period.

5. Right of Withdrawal (EU Consumers Only)

If you are a consumer under EU law and have purchased a digital product, you have the right to withdraw from this contract within 14 days without giving a reason.
However, your right of withdrawal expires once the service begins with your prior express consent and acknowledgment that you thereby lose your right of withdrawal.

6. AI Services and Data Processing (GDPR Compliance)

We process your input solely to generate alt text and similar content. We do not store, use, or share your data for training, analysis, or resale. Input and output are handled according to Art. 6(1)(b) GDPR – for performance of the contract.

7. Intellectual Property

All content, software, code, and branding of AutoAlt.ai are the property of webAufstieg GmbH or licensed partners. You receive a non-exclusive, revocable license to use the platform. Copying, sublicensing, or reselling any part of the service is prohibited.

8. Prohibited Use

You may not use AutoAlt.ai in connection with:

• Financial trading or forecasting tools
• Medical diagnostics or patient-related content
• Pornographic or illegal content

Violation may result in immediate account termination without refund.

9. User-Generated Content

You retain ownership of alt texts and outputs you generate. We do not claim rights to your content. Content is stored only to enhance your user experience and can be deleted at any time via your account.

10. Third-Party Services

AutoAlt.ai integrates with third-party providers (e.g., Stripe, AWS). By using the service, you consent to data being shared as needed with these providers in accordance with Art. 6(1)(b) GDPR.
We are not responsible for the content or practices of third-party websites linked from our service.

11. Limitation of Liability

AutoAlt.ai is provided “as is” without warranties. We exclude all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for direct or indirect damages arising from the use or inability to use the Service, unless caused by intent or gross negligence.

12. Indemnification

You agree to indemnify and hold harmless webAufstieg GmbH, its officers, and affiliates from any claims or damages arising from your violation of these Terms or unlawful use of the Service.

13. Termination

We reserve the right to terminate your access at any time. Termination does not affect any rights or obligations accrued prior to the termination.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions. The exclusive place of jurisdiction is Aalen, Germany.
In case of discrepancies between different language versions, the German version shall prevail.

15. Changes to Terms

We reserve the right to update these Terms at any time. The latest version will be published on our website and will replace previous versions. Continued use after changes implies acceptance.
